Terms of use
These terms apply to www.rk1care.com and, except where a signed customer agreement says otherwise, to CareLogs and other RK1Care products. If you do not agree, please do not use the sites or software. A signed order form or Business Associate Agreement may add terms; those written contracts control if they conflict with this page.
The website
Marketing pages are for general information. Product names, prices, and timelines can change. “Coming next” items are ideas, not a promise to ship.
CareLogs and other products
You (or your organization) are responsible for how the software is used, who has access, the accuracy of information entered, and compliance with laws that apply to you. RK1Care does not provide medical, nursing, or pharmacy services. Output from the software, including AI-assisted features if offered, is not a substitute for professional judgment.
No warranty
The websites and software are provided “as is” and “as available.” To the fullest extent permitted by law, RK1Care, Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components, or that it will meet HIPAA, CIS, CPRA, or other legal requirements on its own.
Limitation of liability
To the fullest extent permitted by law, RK1Care, Inc. and its officers, employees, and contractors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, even if advised of the possibility. Our total liability for any claim arising out of the websites or software is limited to the fees you paid us for the product in the three months before the claim, or fifty U.S. dollars if you paid nothing. Some places do not allow these limits; in those places, our liability is limited to the maximum allowed.
Indemnity
If you use CareLogs or another RK1Care product for an organization, you agree to defend and indemnify RK1Care, Inc. against claims arising from your content, your users, your failure to obtain needed consents or agreements, or your violation of law—except to the extent a claim is caused by our willful misconduct.
